Overview
Malcolm Macpherson is an accomplished Indigenous lawyer and negotiator whose career is centered on advancing economic opportunity, rights recognition, and the flourishing of Indigenous communities across Canada.
Malcolm earned his law degree from the University of Toronto, where he developed a strong foundation in business law and Indigenous law. With more than two decades of experience, he has built one of Canada’s leading legal practices in the Indigenous space. He specializes in the intersection of resource and energy development, land and treaty rights, governance, and environmental and regulatory issues.
Malcolm leads a cross-Canada team, delivering legal and negotiation services oriented toward Indigenous self‑determination, economic development, and sustainable community well‑being. He is sought after by Indigenous Nations and their corporate enterprises, serving as trusted advisor in high‑stakes government‑to‑government negotiations, energy and natural resources projects (including oil & gas, hydrogen, wind, solar), land assemblies, environmental cumulative impacts, and treaty and non-treaty rights oriented litigation.
What sets Malcolm apart is his unwavering belief that Indigenous rights are not merely legal entitlements but foundations for economic transformation: that rights affirmation, when matched with opportunity, can yield lasting impact. He approaches his work with a strategist’s mind and pragmatism—balancing bold vision with practical pathways, ensuring that agreements and litigation materially benefit communities over the long term.
Beyond his practice, Malcolm is engaged in broader sectoral business leadership. He sits on the board of Resource Works, is a governor of the Canadian Energy Executive Association, and contributes to public discourse on resource development and reconciliation. He is an active voice in Canada in conversations about how Indigenous Nations can and should play central roles as co‑resource stewards.
When not advocating for clients, Malcolm prioritizes family and community. He resides in British Columbia, where he and his wife are currently raising their five children.
